Oura terms update (Nov 4, 2026): accept in the app or lose access; jury waiver and mass-arbitration batches added
Oura's Terms of Use now read "Last Updated: October 2, 2026" and "Effective Date: November 4, 2026," replacing the April 20, 2026 version. An Oura help-center article (last updated October 13) says members must accept the new terms in the Oura App by November 4: "After that date, you can't use the Oura App until you accept." The biggest rewrite is the U.S. dispute section. The old terms had one paragraph requiring arbitration and waiving class actions. The new Section XVI has 12 numbered parts. Disputes go to the American Arbitration Association (AAA), the provision "includes a class action and jury trial waiver," it covers any dispute "regardless of when it accrued," and it "supersedes all prior versions." Before filing, you must mail a written "Pre-Dispute Notice" to Oura's agent for service of process in Sacramento and negotiate for 30 days. Claims of $50,000 or less are decided on written submissions unless the arbitrator decides to hold a hearing. A new "Mass Arbitration Procedures" section applies when 25 or more similar claims are filed by people whose lawyers work together: 20 randomly picked cases go first, the rest are paused (with deadlines tolled) until those are decided and a mediation is held, then the next batch of 20 proceeds. Claims exempt from arbitration include small-claims cases, public injunctive relief under California law, and "any claim or cause of action for vexatious litigation." Neither version offers an arbitration opt-out. Other changes: the old promise to email you "at least thirty (30) days in advance" of a fee change is replaced by notice "in advance of the effective date and within the timeframe required by applicable law," plus a new right to cancel before a new fee applies. The liability cap changes from $100 to "the amount paid to Oura in the prior twelve (12) months." The old one-year deadline for filing claims is gone. Renewal charges move from one day before your billing anniversary to the anniversary itself, and you must cancel at least one day before renewal. The data section now says Oura "disclaims all liability that arises out of or in any way relates to any information that you provide or direct to be provided to Oura, even if that information constitutes electronic patient health records," and that Oura "may use, process, or share it, consistent with" the terms and its Privacy Policy. Oura says the update "does not change how Oura collects, uses, or protects member data," and its Privacy Policy is still dated June 15, 2026. The terms also add a "Regulated Features" section that names the Fertile Window feature in Cycle Insights as a medical device in the EU. How it compares (checked October 17, 2026): WHOOP's Terms of Use (last updated August 3, 2026) also require arbitration with a class action and jury trial waiver, but say "UNLESS YOU OPT OUT OF THE AGREEMENT TO ARBITRATE WITHIN 30 DAYS," and let members reject an updated agreement by emailing support@whoop.com within 30 days, keeping the prior terms until their current membership ends. Eight Sleep's Terms of Service (last updated September 16, 2026) say "YOU MAY OPT OUT OF ARBITRATION WITHIN 30 DAYS OF FIRST AGREEING TO THESE TERMS" by writing to legal@eightsleep.com. Oura's new terms offer no arbitration opt-out and no way to reject the update except to stop using the app ("your only recourse is to cease using the Services").
Who it affects
Oura Ring owners and Oura Membership subscribers, especially in the U.S., where the new arbitration rules apply. Everyone has to accept in the app by November 4, 2026 to keep using it
